Please read carefully as these Terms and Conditions define our respective rights and obligations. Once you’ve sent us your enquiry, you agree to accept these terms and conditions by default.
The Terms and Conditions defined hereinafter are referred to and applicable for “Luxurious Villas and Homes” section of the website www.croatiatravelboutique.com, whereas T&T Travel Boutique travel agency / Sole trader for Tourism and business services, Owner Tihana Dolenec, OIB 47538511420, Djordjićeva 5, 10000 Zagreb, CROATIA, undertakes the role of the Intermediary Agency, hereinafter referred to as “T&T Travel Boutique””. T&T Travel Boutique acts as an Intermediary Agency between the Supplier (partner agency) or the owner(s) of Villas/Homes for rental, featured on the website https://croatiatravelboutique.com and the client renting the property, hereinafter referred to as “client” and “party leader”.
This contract incorporates all the conditions below.
- Booking procedure and payment conditions
2.1 Once you have made a provisional reservation with us we will ask you to confirm your booking by e-mail. This must be from the first named person on the booking (‘the party leader’). The party leader must be at least 18 years of age and must be authorized to make the booking on the basis of these booking conditions by all persons named on the booking. By confirming the booking details with T&T Travel Boutique, the party leader confirms that he/she is so authorized and that all party members agree to be bound by the booking conditions.
2.2 The party leader is responsible for making all payments due to us. Once an Invoice has been sent out from T&T Travel Boutique a minimum non-refundable deposit of 50% of the rental cost must be paid. A higher deposit may be required where additional terms have been imposed on us by the property owner/and or supplier partner agency. You will be notified of any unusual deposit conditions prior to receiving from us your booking confirmation. The balance of your booking payment must be received 35 days prior to your check-in date at the Villa/Home, a reminder invoice will not be sent. If booking within 8 weeks from check-in date, the full cost of the villa must be paid at the time of booking.
Bookings received by email are provisional and will be held for 7 days pending receipt of your deposit/full payment as applicable. If your payment is not received within 7 days the booking will automatically be cancelled.
2.3 If you wish to pay by credit card (VISA, MASTER CARD, AMERICAN EXPRESS, AND DINERS) a 3% surcharge will be imposed on the total amount by Supplier Agency’s bank. We will instruct you of the details necessary to proceed with the authorization of the credit card payment and will provide you a credit card form (link) for the payment. Please ensure you quote your booking reference number when emailing us the details. Bank transfer payments can be made in STERLING or EUROS. If you wish to pay by bank transfer please advise us which currency you wish to pay in so that we can issue the Invoice with banking details.
2.4 Parties of young people under the age of 18 are not permitted to make reservations. We reserve the right to reject a reservation without explaining any reason.
3.1 A contract between you, the party leader and the property owner will come into existence when you have paid a deposit (or full payment if booking within 8 weeks from check-in date) and when we accept the booking by issuing a written confirmation. Croatian Law governs your contract and all matters arising out of it. Any disputes, claims or other matters which arise out of or in connection with this contract, will be dealt with by the courts of Croatia only.
3.2 It is important that immediately upon receipt of our confirmation of your booking you check the Villa/Home details. You must contact us straight away if any information appears to be incorrect as it may not be possible to make changes later on. We regret we cannot accept any liability if we are not notified of any inaccuracies that may appear in any document, within 14 days from the date we sent it out.
4.1 The price of your Villa/Home rental is based on Villa/Home rental prices known to us that are published in the catalog on our web page: https://croatiatravelboutique.com
The published prices are valid from the moment of updating the data on the website. Pursuant to Article 3.5 on price changes, the price valid at the time of booking applies. If there are several identical accommodation units with the same description and the same prices in the facility, the total number of units of this type will be stated in the description of the facility, but only one accommodation unit of that type will be described. Special offers do not have to apply to all accommodation units of the same type. Any additional services requested by the client (e.g. additional cleaning, telephone costs, bicycle rental, etc.) are not included in the price and should be paid on the spot to the person responsible for the keys to the facility or to an authorized employee.
The minimum duration of stay is specified for each villa individually. The day of arrival / departure is Saturday, unless otherwise stated for an individual facility. Accommodation prices (IF NOT DECLARED IN THE DESCRIPTION) include: normal electricity consumption, heating in winter and air conditioning in summer, water consumption, gas consumption (if available), final cleaning, bed linen, bath towels and tourist tax for some villa (for those where it is not included, it will be shown separately).
4.2 Many property owners will only accept bookings with a minimum stay of one week in June, July, August and sometimes in September too.
4.3 Properties are fully furnished and equipped. The price for all properties includes linens, electricity, hot and cold water. Occasionally there may be an additional charge for tourist tax, air conditioning/heating where available; you will be advised of this at the time of booking. Where there is a private pool, pool heating will incur an additional expense. Satellite/Cable television where available may not include access to all channels. If internet access is available it is generally assumed that the customer will bring their own laptop. Use of telephone facilities installed in the property must be paid at site, if used.
- SECURITY DEPOSIT
5.1 A security deposit is required to cover the cost of any damages or breakages. The deposit will be collected upon your arrival at the villa. The security deposit usually amounts from € 200 – € 500 per Villa/Home but it varies from one property to other. For telephone use or other services, a higher deposit may be required to cover eventual bills. You will be advised of this at the time of booking. If you decide that you wish to use additional services once you have arrived, the higher deposit will be confirmed to you at the spot. Please bring this amount of money with you when you arrive; otherwise, entry into the property may be postponed until the deposit is presented.
5.2 The deposit is usually refunded at the end of your stay, upon the inspection of the Villa/Home. In some instances, delays of up to 8 weeks in returning the deposit are caused due to awaiting utility bills or proof of damage, or due to bank credit card fee authorization. No calls to the owner to expedite the receipt of bills will be made until 4 weeks after the return date.
- OTHER CHANGES
If you wish to make other changes to your booking after it has been confirmed, you must notify us in writing as soon as possible. We will do our best to help you, but we cannot ensure it. An amendment fee of Euro 50.00 per booking will be applicable along with any additional costs incurred as a result of the change. If you request a change to your reservation within 42 days of your check-in date, we may consider it a cancellation. In this case, the charges listed in paragraph 7.1 cancellation charge table would apply.
7.1 If you wish to cancel your booking you may do so in writing to our email address: email@example.com. We will not be held liable for any erroneous email or failure to send email to either party. Please double-check that your cancellation was sent to the correct email address and that you received a response from us within 24 hours. Please resend your email if you have not received a response from us.
All Cancellations will take effect from the date received by T&T Travel Boutique. In all cases, a cancellation will only be accepted if sent by the party leader. If you cancel, 50 % amount (deposit payment) is non-refundable in any circumstance, and the remaining 50 % payment is non-refundable if paid within 35 days of arrival.
7.2 Cancellation charges are calculated as a percentage of the total Villa/Home rental cost. Depending of the reason for your cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your insurance policy. Claims must be made directly to the insurance company concerned. T&T Travel Boutique strongly recommends that you purchase travel insurance when booking your Villa/Home rental.
- CHANGES AND CANCELLATIONS BY US
In the unlikely event that alterations and cancellations have to be instigated by us, we will inform you as soon as possible and if requested we will try to arrange alternative accommodation of a similar type, standard, and location.
9.1 If you have a problem while staying at your booked Villa/Home, please notify our local representative/agent/Villa (Home) owner as soon as possible so that they can resolve it immediately.
If no representative/agent/Villa (Home) owner is available in that area, please contact us. Failure to notify us of any problems while you are in the Villa/Home would result in your complaint being dismissed.
- ARRIVAL AND DEPARTURE
Clients are expected to arrive after 16.00 pm Croatian time and to depart by 10.00 am. There may be slight variations to these times +/- one hour. Your travel documentation will include the correct Arrival/Departure times for your rental of the property.
If you arrive outside of these times, you must notify us in writing as soon as possible, or if any unforeseeable circumstances arise, you must contact your contact person who is waiting for you as soon as possible.
If you plan to arrive after 23:00 p.m., you must first obtain our approval for this type of late arrival. In some cases, late arrivals may be subject to additional charges.
11.1 The party leader is responsible for ensuring that the parties have the proper travel documents (passports and visas, driving licenses, vehicle registration, green card, motor insurance etc.).
11.2 T&T Travel Boutique cannot be held responsible for issues arising as a result of non-confirmation of your flight booking, so it is crucial that you secure your travel (e.g. flights) arrangements at the same time as booking a Villa/Home.
- YOUR RESPONSIBILITIES
12.1 You must maintain the property, including all furniture, fittings, effects, facilities, equipment, and grounds, in the same state and condition as when you arrived, as well as the same level of cleanliness and general order as when you arrived.
Any breakages, losses, or damage to the property will be your responsibility. Once again, we strongly advise you and all party members to obtain appropriate insurance coverage.
For any further cleaning beyond the number of hours committed, the property owner reserves the right to deduct money from the security deposit.
12.2 Parking of caravans/pitching of tents is strictly forbidden at Villa/Home rental properties.
- NUMBER OF PEOPLE USING THE PROPERTY
The property is only available to those named at the time of booking. The maximum number of persons allowed on the property, including infants, must not be exceeded. If the numbers are exceeded, the owner has the right to cancel the rental without notice and without a refund.
The property owner or their representative must have reasonable access to the property in order to perform necessary maintenance and/or inspection.
- CLIENTS’ BEHAVIOR
The person signing the contract is responsible for the party’s proper and decent behavior. If you or a member of your party misbehaves, the property owner or local representative/agent may, at their discretion, ask you and your party to leave the property without compensation.
- ADDITIONAL SERVICES
Please allow as much time as possible for the organization of additional services, such as those listed in paragraph 5. Payment is normally made on the spot for such services. We cannot be held liable for any additional services.
All properties come with linens and a linen change. It’s a good idea to bring a beach towel and double-check that cot linen would be provided.
- SWIMMING POOLS
Swimming pools do not remain open throughout the year. Please contact us to confirm whether or not the pool is open. If pool heating is required, an additional fee will be charged and deducted from the security deposit.
- SOCIAL EVENTS AND OTHER FUNCTIONS
T&T Travel Boutique acts as an Intermediary Agency for the Supplier (partner agency) or the owner(s) of Villas/Homes for the private rental of a property. If you are intending to organize a private function (e.g. party, wedding, cocktail party) at the property, you must seek prior permission from T&T Travel Boutique. Additional charges and/or increased security deposit may be sought at the owner’s discretion.
- SECURITY AND VALUABLES
You are responsible for any valuables you leave on the house. Their loss is not the fault of T&T Travel Boutique or the property owner. If you plan to leave the property as a result of a break-in, you will not be offered a refund.
21.1 Although we make every effort to ensure that the descriptions provided are correct, we cannot be held responsible for any errors or the effects of such errors. Minor variations between the photograph/illustration/text used and the real property must be accepted.
21.2 Property owners reserve the right to make any changes to the property specifications that they deem appropriate due to operational needs. Property owners reserve the right to modify furniture, fittings, services, equipment, or any part of any operation, whether advertised or previously available, without advance notice in the interest of quality improvement.
21.3 If there are significant changes to the interior or exterior of the property after your booking has been confirmed, we will notify you if there is time until your check-in.
Pets are not allowed unless with the explicit permission of the owner. The owner reserves the right to add a surcharge and/or increase the security deposit. A number of pets must be agreed prior to acceptance of the booking.
23.1 Please be aware that many of our properties are located in rural or remote areas, and as a result, you can come across flora and fauna such as mosquitoes, wasps, ants, local dogs, and other environmental activities such as farming, drains, and so on. Some of the properties are situated on unpaved roads.
23.2 Many of our properties are over hundred years old, and some are also listed as such. As a result, the structure and safety features may not have been updated. While T&T Travel Boutique makes every effort to include as much information as possible about each property, such as when it was constructed and whether it is appropriate for children or people with walking difficulties, this could mean that the property is less safe than one that was built more recently.
Additionally, due to the rugged nature of the Croatian coastline, some of our coastal properties may have steep approaches, several stairs, or be positioned on a rocky promontory.
Although the location is beautiful, it may not be ideal for all types of customers, and every attempt is made to remind you of this on the villa details. If any of members of the party have any difficulties, we should be advised at the time of booking so that we can provide timely information.
23.3 Please notice that we are not responsible for any construction or roadwork that occurs near the house. We will make every effort to notify you of any work that is being done if we are aware of it, but work can happen at any time without our knowledge.
- OUR LIABILITY AND THE PROPERTY OWNER
24.1 Neither T&T Travel Boutique, as an Intermediary Agency, nor the Supplier (partner agency) nor the owner(s) of Villas/Homes shall be responsible for the death or personal injury of any member of a booking party or any other person at the property unless this results from the proven negligence.
24.2 T&T Travel Boutique, as an Intermediary Agency, nor the Supplier (partner agency) shall not be liable for any loss, breach or delay due to any cause beyond our reasonable control including though not limited to acts of God, explosion, tempest, fire or accident, war or threat of war, civil disturbances, acts, restrictions, regulations, bye-laws or measures of any kind on the part of the government or local authority, strikes, lock-outs or other industrial actions or disputes or adverse weather conditions. In any case, we shall be entitled to treat the contract as discharged.
24.3 T&T Travel Boutique, as an Intermediary Agency, nor the Supplier (partner agency) cannot be held responsible for the breakdown of mechanical equipment such as pumps, boilers, swimming pool filtrations systems, nor for the failure of public utilities such as water, gas, and electricity.
24.4 Neither T&T Travel Boutique, as an Intermediary Agency, nor the Supplier (partner agency) nor the owner(s) of Villas/Homes rented cannot be held responsible for noise or disruption that originates beyond the property’s limits and is beyond our control. If we become aware of a source of noise prior to your arrival, we will contact you to notify you of the disturbance.
24.5 T&T Travel Boutique cannot be held liable for incidents outside our control, such as bad weather, including events resulting from extremely hot or unusual weather, airline delays, or a malfunction of household equipment.
- WEBSITE LINKS
We may create links from the T&T Travel Boutique website to other sites that we believe would be of interest to customers planning a villa vacation from time to time. The acts or content of these websites are not the responsibility of T&T Travel Boutique. It is your responsibility to check of the status of the sites you visit.
- SPECIAL REQUESTS
We will make every effort to accommodate any requests you may have prior to arrival, but we cannot promise that we will be able to do so. Special requests are not included in our contractual commitments to you, and we will not be held responsible if they are not fulfilled.
